Part 2A only deals with those landfills that do not have a Waste Management Licence. If a site does have a Waste Management Licence it is regulated by the Environment Agency.

Part 2A may or may not be able to be used on sites with some other controlling permission such as a Resolution, a CoPA 1974 consent, or a Planning consent with conditions.
 
Part 2A is only supposed to be used as a last resort where other legislation takes precedence or is more appropriate to use.
