Local Land Charges

A Local Land Charge is a binding obligation on property or land, which passes to successive owners or occupiers, therefore it is vital to check if any charges exist before purchasing property/land to ascertain if there are any legal obligations attached to the charge.

Any charges registered on a Local Land Charges Register would not normally be disclosed in the title deeds or by an inspection of the property/land itself. Charges maybe of a financial or non-financial nature.

A statutory requirement is placed on all Local Authorities within England and Wales to generate, maintain and regularly update a Local Land Charges Register and to provide Local Searches.

The Land Charges Section maintains the Local Land Charges Register. This register is updated daily in order to provide answers to Search requests, using information provided by various departments of the Council e.g. Planning, Highways.

A Local Land Charges Search is an important step in the process of buying or leasing a new home or business premise.

The Local Land Charges Section carries out all official searches covered by the Local Land Charges Act 1975, guaranteeing comprehensive replies to official enquiries for:
  • LLC1 - registerable charges, improvement grants, tree preservation orders etc.
  • CON29R - road schemes, planning history etc.
  • CON29O - further enquiries (optional)
The two components that comprise a standard search are the LLC1 and CON29R.  You can also ask a wider variety of questions that include the Common Land (Commons) question via a CON29O. For full details please view the FAQ "Which questions are on each form?"

Search fees are :

LLC1 £11.00
LLC1 (additional parcel) £1.00 per parcel
CON29R (residential)    £100.00
CON29R (commercial) £109.00
CON29R (additional parcel) £15.00 per parcel
CON29O    £9.00 per question

Blackpool Council has received the Information Commissioner's Office (ICO) Guidance document in relation to accessing and charging for information and is currently in the process of interpreting its contents.

The Council is not obliged to follow the guidance of the ICO on this issue, as it is not statutory , therefore has chosen not to follow this guidance at this moment in time pending legal opinion which the Local Government Association (LGA) is seeking on behalf of the sector.
