Noise Pollution Control

Noisy construction work from tradesmen / builders should be carried out between 8am and 6pm Monday to Friday applying the most practical means (the right tools for the job not entailing excessive costs).

Each case is individually judged, taking into account how frequently the noise is occurring, the type of work and how early or late it is taking place.
 
Noisy fans, extractors or mechanical plant can also cause a noise nuisance. 

Mechanical plant at commercial or industrial premises is often located near residential premises.

When assessing whether noise from a mechanical plant is a nuisance Environmental Services refers to a British Standard, taking in to consideration any intrusive, tonal components.

Owners of intruder alarms should:

  • fit a cut off switch to stop the alarm sounding for more than 20 minutes;
  • provide the Council with contact details of the two key holders;
  • provide the Police with the details of the two key holders;
  • ensure the system is correctly installed;
  • follow the UK Code of Practice on Noise from Audible Intruder Alarms
The Council has a duty to investigate noise nuisance and take steps to address any nuisance. If the Council is satisfied that an alarm is causing a nuisance in law, we will try to contact the owner / key-holder to arrange for the alarm to be silenced and reset.

If this cannot be arranged and the Council and Police have not been given the key-holders details then the Council will serve a Noise Abatement under the Environmental protection Act 1990 requiring that the alarm be silenced and the owner provide key-holders details and install a 20 minutes cut-off period. A contractor appointed by the Council to disconnect the alarm will often do so by disconnecting the external alarm box.

Unfortunately the Owner then faces the cost of making the alarm work again (disconnection often results in physical damage) and will receive a separate bill from the Council for disconnection plus VAT plus administrative charges. The owner may also be liable for prosecution for causing nuisance.
