Provisional statement (Gambling Act 2005)

If your premises are still to be constructed, or are undergoing substantial alterations, you can apply for a provisional statement under the Gambling Act 2005 to establish whether the premises would be granted a licence after the building works are complete.

They can also be applied for prior to concluding legal arrangements to purchase or lease the premises. This is because a premises licence cannot be applied for until the applicant has a right to occupy the premises.

Apply for a provisional statement

The application procedure is the same as for a premises licence except that you do not need to hold, or have applied for, an operating licence.

Please read the guidance notes before applying – this gives information about the application procedure including requirements for submitting plans and the respective fees. 

Each of the responsible authorities need to be notified of the application using a template form provided by the Gambling Commission - Form A must be used when there is only one applicant, for two or more applicants use Form B.

You will also need to advertise the application in the local paper and by displaying a notice on the premises using the template provided by the Gambling Commission.

Download and complete the application form and submit with a plan of the premises and the correct fee.

After the provisional statement has been granted, the licensing authority may only refuse the application for the full premises licence on limited grounds.

This gives the holder of the provisional statement some confidence that if your circumstances do not change and you abide by the requirements of the provisional statement, you should receive the premises licence.
