Promenade article 4 direction order

Town and Country Planning (General Development) Order 1949

The Minister of Town and Country Plamning in pursuance of the powers reserved to him by Article 4 of the Town and Country Country Plarning (General Development) Order, 1948, hereby approves the above Direction, subject to the following modification:

Schedule

The use of land (other than a building or curtlilage of a building which has been demolished in consequence of war damage) for any purpose on not more than 28 days in total in any calendar year, and the erection or placing of moveable structures on the land for the purpose of that use, being development comprised within paragraph 2 of Class IV referred to in the first Schedule to the said Order as amended by the Town and Country Planning (General Development) Amendment Order, 1949, and not being development comprised within any other Class.

Whereas the Council of the County Borough of Blackpool being the local planning authority for the said County Borough of Blackpool are satisfied that it is expedient that development of the description set out in the Schedule hereto should not be undertaken in the land in the County Borough of Blackpool situate one the westerly side of a red line shown on the eight plans annexed hereto and marked respectively "A", "B", "C", "D", "E", "F", "G", and "H" unless permission therefor is granted on application made under the Town and Country Planning (General Development) Order 1948.

Now therefore the said Council in pursuence of the powers conferred upon them by Article 4 of the Town and Country Planning (General Development) Order, 1948, hereby direct that the permission granted by Article 3 of the said Order shall not apply to development on the said land of the description set out in the Schedule hereto

Schedule

The use of the land unoccupied by buildings for any purpose for a period or periods not exceeding 28 days in total in any calendar year, and the erection or placing of moveable structures on the land for the purposes of that use, being development comprised within Class IV referred to in the First Schedule to the said Order and not being development comprised within any other Class.
